VMS Watch is a convenience tool that attempts to monitor the camera and video-management systems you connect and to send notifications about their status. Monitoring depends entirely on third-party platforms (Hik-Connect, DW Spectrum, EZView, Guarding Vision, and similar), on email/SMS/telephone carriers, and on networks that we do not control. Nothing about the service is guaranteed: not the accuracy or timeliness of any status, not the delivery of any alert, and not the availability of the service itself.
VMS Watch is not an alarm system, a security service, an emergency-response service, or a life-safety product, and must never be relied on as one. Do not use it to protect life, health, or property. You are solely responsible for maintaining professional monitoring, alarms, and emergency procedures appropriate to your risks.
You are responsible for everything done under your account, for the accuracy of the information you provide, for keeping credentials confidential, and for having full authorization for every system you connect. You use the service entirely at your own risk.
By creating an account you agree to receive service messages by email and text (SMS), including one-time verification codes and the alerts you enable. Message and data rates may apply. We are not responsible for messages that are delayed, blocked, filtered, or not delivered for any reason.
Paid plans and add-ons are billed through our payment processor on the interval shown at checkout, and except where required by law all fees are non-refundable. Plans, prices, quotas, and features may change at any time; some plans do not renew and end after one term. We may suspend or terminate any account at any time for any reason, including non-payment or misuse.
Do not use VMS Watch to violate any law or the rights of others, to monitor systems you are not authorized to access, or to interfere with the operation of the service.
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE”, WITH ALL FAULTS AND WITHOUT WARRANTY OF ANY KIND. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS, IMPLIED, OR STATUTORY, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, RELIABILITY, AVAILABILITY, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT MONITORING WILL BE CONTINUOUS, THAT ANY EVENT WILL BE DETECTED, OR THAT ANY ALERT WILL BE SENT OR RECEIVED.
TO THE FULLEST EXTENT PERMITTED BY LAW, VMS WATCH AND ITS OWNERS, OPERATORS, EMPLOYEES, AND SUPPLIERS SHALL NOT BE LIABLE FOR ANY DAMAGES WHATSOEVER ARISING OUT OF OR RELATED TO THE SERVICE OR THESE TERMS — INCLUDING DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES; LOSS OF PROPERTY, PROFITS, DATA, OR GOODWILL; PERSONAL INJURY; THEFT, VANDALISM, OR OTHER CRIME; OR ANY LOSS ARISING FROM A MISSED, DELAYED, FALSE, OR INCORRECT NOTIFICATION OR STATUS, FROM SERVICE DOWNTIME, OR FROM THE LOSS OF A BACKUP — REGARDLESS OF THE THEORY OF LIABILITY AND EVEN IF WE WERE ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IF, NOTWITHSTANDING THE FOREGOING, ANY LIABILITY IS FOUND, OUR TOTAL AGGREGATE LIABILITY SHALL NOT EXCEED THE FEES YOU PAID FOR THE SERVICE IN THE ONE (1) MONTH BEFORE THE CLAIM AROSE. SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS, SO PARTS OF THIS SECTION MAY NOT APPLY TO YOU; IN THAT CASE LIABILITY IS LIMITED TO THE SMALLEST AMOUNT PERMITTED BY LAW.
You agree to defend, indemnify, and hold harmless VMS Watch and its owners, operators, and employees from any claims, damages, and expenses (including reasonable attorneys' fees) arising from your use of the service, the systems you connect, or your breach of these terms.
We may change the service or these terms at any time. Continued use after an update means you accept the revised terms.
